General Terms and Conditions of Sale
1. Purpose
These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between Pixelorigin - PlanyFit and its clients for the subscription to online planning services.
2. Services offered
PlanyFit offers several annual subscription plans:
- Discovery: Free plan with limited features
- Essential: Intermediate plan for small structures
- Professional: Complete plan for professionals
3. Pricing and payment
3.1 Pricing
Subscription prices are indicated in euros including VAT and are valid for a period of one year. Prices may be modified at any time, with modifications applying to new subscriptions.
3.2 Payment
Payment is made online by credit card via our secure payment provider. Payment is due immediately upon order.
3.3 Invoicing
An invoice is automatically issued after payment confirmation. It is available in the customer area and sent by email.
4. Duration and renewal
Subscriptions are taken out for a period of one year. They are renewed by tacit agreement, unless terminated by either party at least 30 days before the due date.
5. Right of withdrawal
In accordance with applicable consumer protection laws, the customer has a 14-day period to exercise their right of withdrawal. This right does not apply once the service has been fully executed.
6. Liability
PlanyFit undertakes to ensure the availability of the service as far as possible. The liability of PlanyFit cannot be engaged in case of force majeure, internet outage or any other cause beyond its control.
7. Data protection
Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR). The customer has the right to access, rectify and delete their data.
8. Intellectual property
All elements constituting the service (logos, texts, images, software) are the exclusive property of PlanyFit. Any reproduction is prohibited without prior authorization.
9. Disputes
In case of dispute, an amicable solution will be sought before any legal action. Failing an amicable agreement, the courts of Tarbes shall have exclusive jurisdiction.
